Conditions d’utilisation

1. Store Operator and Scope

The website trades under the name cookinstores.shop. Customer-service communications may be sent to info@cookinstores.shop. The legally responsible operator must disclose its full identity and statutory information in the Legal Notice. These Terms do not substitute for those mandatory disclosures.

2. Eligibility and Consumer Status

You must have legal capacity to enter a contract or act with the authorisation of a legal representative. Consumer protections described in these Terms apply to individuals acting for purposes outside their trade, business, craft or profession. Business purchases may be subject to different mandatory rules.

3. Product Information

We take reasonable care to describe products accurately. Images are illustrative and colours may vary between displays or production batches. Dimensions, capacity, materials, heat-source compatibility, voltage, plug type, included accessories and care instructions should be checked before purchase. A statement that an accessory is ‘compatible’ applies only to the models or specifications expressly identified.

4. Prices and Payment

The price shown at checkout is the price payable for the product, subject to correction of obvious errors before acceptance. Standard delivery is free. Available payment methods are displayed at checkout and may be provided by third-party payment processors. You authorise the selected provider to charge the amount shown. We may carry out proportionate fraud, address and payment checks.

5. Order Process and Contract Formation

Placing items in a basket does not reserve stock. Before submitting an order, you can review and correct the contents, delivery information and total price. An automated acknowledgement confirms receipt but does not necessarily mean the order has been accepted. The contract is formed when we send an acceptance or dispatch confirmation, or when performance otherwise begins, subject to applicable law. We may reject or cancel an order for stock errors, payment failure, suspected fraud, shipping restrictions, manifest pricing errors or legal compliance reasons. Any captured payment for a cancelled order will be refunded.

6. Delivery

All orders receive free standard delivery. Estimated delivery is 15–20 calendar days after dispatch. This is an estimate unless a binding delivery date is expressly stated during checkout or confirmation. We will provide available tracking information. Separate items may arrive in separate parcels. Risk of loss generally passes to a consumer when the consumer or a designated third party physically receives the goods, except where the consumer independently appoints a carrier not offered by us.

7. Delays and Non-Delivery

If delivery is delayed, contact us so that we can investigate. Mandatory French rules concerning agreed delivery dates, additional reasonable periods, contract cancellation and refund remain applicable. An operational estimate does not remove the seller’s duty to state and respect the delivery commitment presented before purchase.

8. Customer Responsibilities

Provide complete and accurate billing, email, telephone and delivery information.

Review product dimensions, compatibility, materials and safety information before purchase.

Ensure that an adult or authorised person can receive the parcel where required.

Inspect the parcel promptly and contact us about visible damage or errors.

Use, clean, install and store products according to their instructions and normal safety practices.

9. Returns, Withdrawal and Guarantees

The separate Return and Refund Policy explains the voluntary 30-day return policy, the statutory 14-day withdrawal right, return costs, refund timing and exclusions. Products remain protected by mandatory legal guarantees, including the legal guarantee of conformity and the guarantee against hidden defects where applicable. No manufacturer warranty replaces those rights.

10. Safe Use of Kitchen Products

Cookware, knives, glassware and electrical products can cause injury if misused. Follow warnings and instructions; confirm hob, oven, microwave, dishwasher, voltage and plug compatibility; use appropriate protection around hot surfaces; and keep sharp, breakable and electrical products away from children. Stop using any product that appears damaged, cracked, overheated or electrically unsafe and contact us where a defect may exist.

11. Intellectual Property

The website’s text, graphics, logos, layout, product curation and other protected content are owned by or licensed to the operator. You may use the site for personal shopping purposes. You may not reproduce, scrape, republish, sell, reverse engineer or exploit protected content except as permitted by law or with written permission. Third-party trade marks remain the property of their owners.

12. Prohibited Use

Using the site for unlawful, fraudulent or abusive activity.

Introducing malicious code or attempting to bypass security or access controls.

Interfering with checkout, inventory, pricing or another user’s activity.

Submitting false reviews, impersonating another person or misusing personal data.

Automated extraction or commercial reuse that infringes rights or disrupts the service.

13. Reviews and User Content

If you submit a review, image or other content, it must be truthful, relevant, lawful and non-infringing. You grant the operator a non-exclusive licence to display and format it for store-related purposes, subject to privacy law. We may moderate content for legality, authenticity, relevance and security, but will not suppress a genuine negative review merely because it is unfavourable.

14. Availability and Liability

We do not promise uninterrupted website availability. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including mandatory liability for non-conforming goods, fraud, wilful misconduct, death or personal injury where exclusion is prohibited. To the extent permitted by law, we are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses suffered by a consumer acting outside business purposes.

15. Force Majeure

A party is not liable for delay caused by an event legally recognised as force majeure, to the extent and for the period that performance is prevented. We will communicate material disruption and take reasonable steps to limit its effects. Mandatory rights concerning delayed delivery and refunds remain unaffected.

16. Complaints and Dispute Resolution

Contact info@cookinstores.shop first so that we can attempt an amicable resolution. French consumers have access to a consumer mediation process after a prior written complaint remains unresolved, but the trader must appoint and publish the name and contact details of its competent mediator. Those details cannot be invented and must be added to the live website and applicable terms by the operator.

17. Governing Law

These Terms are governed by applicable French law for sales directed to consumers in France, without depriving a consumer of mandatory protections available under the law of the consumer’s habitual residence where those protections apply. Competent courts are determined by mandatory procedural and consumer rules.

18. Changes and Severability

We may update these Terms prospectively. The terms accepted at the time of an order continue to govern that purchase unless a mandatory law requires otherwise. If a provision is invalid or unenforceable, the remaining provisions remain effective to the extent legally possible.
